INK Exclusives, powered by Vonality Loyalty Solutions ("we", "us", or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and protect email addresses and related personal information when you interact with us, including when you sign up for our marketing communications. It applies to our activities in Canada and is designed to meet the requirements of applicable Canadian privacy laws and anti‑spam rules.

1) Who we are

2) Scope of this Policy

This Policy covers personal information we collect in the course of our commercial activities, including from:

  • newsletter or waitlist sign‑ups;
  • account creation, purchases, or event registrations;
  • business inquiries and customer support;
  • contests, surveys, or promotions; and
  • our websites, landing pages, or social media forms.

This Policy does not apply to third‑party websites or services we do not control. Where our emails link to other sites, their privacy policies govern.

3) What information we collect

We may collect:

  • Contact details: email address, first and last name, company, role/title.
  • Marketing preferences: topics you select, opt‑in/opt‑out status, timestamps and source of consent.
  • Transactional context (if you are a customer): order history, support history, and related metadata needed to determine whether we have an existing business relationship.
  • Technical data: IP address, device/browser information, and cookie or pixel data related to how you interact with our emails and websites (see Section 10).

We do not intentionally collect sensitive personal information through our marketing sign‑up flows.

4) Why we collect and use your information

We collect and use email addresses and related personal information to:

  • send marketing and promotional communications about our products and services;
  • send newsletters, event invitations, surveys, and special offers;
  • provide customer service and respond to inquiries;
  • manage contests and promotions;
  • understand the performance of our campaigns (e.g., open/click rates) and improve our products and services; and
  • maintain records of consent and compliance.

We will not send you marketing emails without an applicable form of consent or other legal permission under Canadian law. You can withdraw your consent at any time (see Section 7 and 8).

5) Email marketing & anti‑spam compliance (summary)

We follow a permission‑based approach to marketing emails. In practice, this means:

  • We send commercial emails only where we have express consent (you clearly opted in), or implied consent or a recognized exemption applies (e.g., an existing customer relationship or certain business‑to‑business scenarios relevant to a recipient’s role).
  • Every marketing email identifies us and includes a free, easy‑to‑use unsubscribe mechanism. We honor unsubscribe requests promptly.

6) Consent: express, implied, and business‑to‑business

Express consent. We seek clear, affirmative opt‑in consent where feasible (e.g., checkboxes that are not pre‑ticked, double‑opt‑in, or verbal/written consent captured by our teams).

Implied consent (customers & inquiries). In some cases the law permits us to email you based on an existing business relationship (for example, if you purchased from us within the past two years) or if you made an inquiry or application within the past six months. We track the relevant dates and limit emails to those periods unless you provide express consent.

Business‑to‑business and conspicuous publication. We may send emails without express consent to business recipients where the law allows, such as when a recipient’s business email address is conspicuously published or provided (e.g., on a company website or business card) without a “no‑CEM” statement and our message is relevant to the person’s role or functions. We limit such outreach to professional contexts and respect any opt‑out signals.

Record‑keeping. We maintain logs of consent (type, date/time, method, source, and scope) and will update or remove contacts when consent changes or expires.

7) Your choices: unsubscribing and withdrawing consent

  • Every marketing email contains an unsubscribe link. You can also contact us to opt out.
  • We will stop sending you marketing emails without undue delay. (Operational notices or service messages may still be sent if you are a customer.)
  • If you unsubscribe from marketing, we keep minimal records to ensure we respect your choice in the future.

8) Your privacy rights (Canada)

Subject to limited exceptions, you may request to access the personal information we hold about you, correct inaccuracies, or withdraw consent to our processing. To exercise these rights, contact us using the details above. We may need to verify your identity and may be unable to provide access to information that contains other individuals’ information or is otherwise restricted by law.

9) Sharing your information

We do not sell your personal information. We share information only as needed to:

  • Service providers (e.g., email delivery, marketing platforms, analytics, customer support), who must protect it and use it only for our instructions;
  • Business transfers (e.g., merger or acquisition), where permitted by law and with safeguards; and
  • Legal reasons (e.g., to comply with law, respond to lawful requests, or protect our rights, users, or the public).

Where we engage service providers, we remain responsible for your personal information and require appropriate safeguards.

10) Cookies, pixels & analytics

We and our service providers use cookies, tags, SDKs, and email pixels to:

  • remember your preferences;
  • measure email and site performance (opens, clicks, conversions);
  • understand aggregate audience interests; and
  • tailor content and ads.

You can manage cookies through your browser settings and opt out of marketing emails at any time (which disables email‑based tracking for those messages).

11) International transfers

Some of our service providers may be located outside Canada (for example, in the United States). As a result, your personal information may be processed in other jurisdictions and may be accessed by courts, law enforcement, and national security authorities in those jurisdictions. We take steps to ensure that any such transfers are subject to appropriate safeguards and contractual protections.

12) Security

We use administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, use, or disclosure. However, no method of transmission or storage is 100% secure.

13) Retention

We keep personal information only as long as necessary to fulfill the purposes described in this Policy or as required by law. Where we rely on implied consent, we limit email marketing to the applicable period (for example, two years after a purchase or six months after an inquiry) unless you provide express consent or we are otherwise permitted to continue communications. We anonymize or securely delete information when no longer needed.

14) Children’s privacy

Our marketing communications are intended for adults. We do not knowingly collect personal information from children under the age of 13. If you believe a child has provided us an email address, please contact us to request deletion.

15) Changes to this Policy

We may update this Policy from time to time. If we make material changes, we will notify you by email or by posting a notice on our website and update the "Last updated" date above.
